ARTICLE 1. GENERAL
1.1 These conditions apply to all tickets sold through Ticketsplus, unless expressly stated otherwise. Tickets purchased through the Ticketsplus web shops are hereinafter referred to as "Tickets".
1.2 The applicability of these terms and conditions to the purchase of Tickets does not affect the applicability of other terms and conditions, such as those of the organizer of the event to be attended or the operator of the park to be visited. These conditions can be requested from the relevant party.
1.3 The Ticketsplus web shops are an activity of Ticketsplus BV (hereinafter referred to as "Ticketsplus"), Almijstraat 14, 5061 PA in Oisterwijk. Ticketsplus offers admission tickets for concerts, trade fairs, amusement parks, and other events, hereinafter referred to as the "Event".
1.4 In these general terms and conditions, "Event organizer" means the natural or legal person who produces or organizes an Event and is responsible for it, including the natural or legal person who operates an amusement park, trade fair, or concert.
ARTICLE 2. CONCLUSION OF AGREEMENTS
2.1 All offers from Ticketsplus are without obligation and subject to availability.
2.2 Ticketsplus may act as an agent or as a buyer and seller on behalf of the Event organizer. The exact role of Ticketsplus is further specified in the general agreement between the parties.
2.3 Ticketsplus is entitled to (have) verify the data provided by the purchaser for accuracy. Providing incorrect or incomplete information may result in no agreement being reached and/or the Tickets not being sent.
2.4 Ticketsplus is entitled to refuse orders or to attach certain conditions to the delivery, even without giving reasons. The agreement is always concluded subject to the suspensive condition that Ticketsplus does not accept the order. If an order is not accepted, Ticketsplus will notify the purchaser in writing (by email) within 3 working days after receipt of the order.
2.5 The Tickets are presented on the purchaser's computer screen after payment. The purchaser must print this document and bring it to the Event.
ARTICLE 3. PRICES AND PAYMENTS
3.1 The prices stated are in euros, including VAT, any taxes or other levies, and excluding service charges.
3.2 Ticketsplus expressly reserves the right to change the prices of Tickets, particularly if this is necessary due to legal regulations. In the event of limited availability of an offer, Ticketsplus reserves the right to offer the same Tickets again at a higher price once the offer is no longer available, without the purchaser being able to rely on the previous (lower) price.
3.3 Payment can be made in the manner(s) indicated during the ordering process. Additional payment/order conditions may apply. In the event of any technical malfunctions preventing the (credit card) payments from being processed and/or authorized, Ticketsplus is not liable.
3.4 For security reasons, the number of Tickets that can be ordered by credit card payment is limited.
3.5 If the purchaser is in default with any payment, Ticketsplus is entitled to suspend (the execution of) the agreement.
3.6 Reversing a payment made to Ticketsplus does not release the purchaser from his payment and acceptance obligations.
3.7 If Ticketsplus has to incur (extra-)judicial collection costs to collect the amount owed by the purchaser, these costs will be borne by the purchaser, with a minimum of twenty-five (25) euros.
ARTICLE 4. USE OF TICKETS
4.1 Tickets cannot be returned or exchanged and lose their validity upon the expiry of the validity period indicated on them.
4.2 Tickets may not be folded or otherwise damaged. The purchaser bears the risk of this. In the event of damage, access may be refused and the purchaser is not entitled to any refund or replacement.
4.3 Purchasers of tickets must show them, even after entering the event, at the first request of the organizer. The organizer of the event also has the right to ask for personal identification.
4.4 Tickets may only be resold if the general terms and conditions of the organizer of the event allow this.
4.5 It is prohibited to use tickets for commercial purposes without written permission from the organizer of the event or the trade fair and from Ticketsplus.
4.6 Each ticket has a unique barcode and can therefore only be used once. Copying tickets is useless. Misuse will be reported to the authorities.
4.7 After receipt, the purchaser must check the tickets as errors cannot always be corrected. Tickets cannot be exchanged or refunded after they have been ordered. If the ticket is so damaged that it can no longer be verified as authentic, the purchaser can contact the Ticketsplus customer service at [email protected]
4.8 Special requests, such as reserving wheelchair spaces, must be made known in a timely and explicit manner. Ticketsplus cannot guarantee that special requests can be met. For more information, the purchaser can contact the Ticketsplus customer service at [email protected].
ARTICLE 5. EVENTS
5.1 Change, relocation, rescheduling - If Ticketsplus learns from the Event Organizer that an event has been changed, relocated or rescheduled, Ticketsplus will attempt to inform the Purchaser. Ticketsplus will take the necessary care in this regard, but cannot guarantee it.
5.2 Responsibility of the Purchaser - It is and remains the responsibility of the Purchaser to find out whether an event has been changed, relocated or rescheduled and to determine the new form, location or time. Tickets for rescheduled events are usually valid for the replacement event. Ticketsplus is not obliged to reimburse the Purchaser for any costs incurred by the Purchaser as a result of the change, relocation or rescheduling. If an event is rescheduled to a different location or date, the Event Organizer may impose additional conditions on the tickets and their prices.
5.3 Cancellation - If an event is cancelled, the Purchaser may return the tickets for this event to Ticketsplus. Ticketsplus will then refund the ticket price of the relevant tickets to the Purchaser. Booking and administration fees will not be refunded. With regard to cancellation, the general terms and conditions of the Event Organizer may also apply.
ARTICLE 6. OBLIGATIONS AND LIABILITY OF TICKETSPLUS
6.1 Ticketsplus is responsible for the sale, delivery and settlement of tickets, and in some cases for facilitating the corresponding access control.
6.2 Providing information regarding the event (e.g. in the event of cancellation or discontinuation of ticket sales) is the responsibility of the Event Organizer. Ticketsplus is not liable for incomplete or incorrect information provided by the Event Organizer.
6.3 Complaints regarding the event can be made known to Ticketsplus customer service at [email protected]. Ticketsplus will forward complaints to the Event Organizer, but is not responsible for, and does not provide any guarantee for the quality and content of the event and does not accept any liability in this regard.
6.4 Ticketsplus is never liable for damage, in any form or for any reason, caused during or as a result of a visit to the event.
6.5 Ticketsplus is not liable for inaccuracies, delays or improper delivery of orders and communications in the communication between the Purchaser and Ticketsplus, unless and to the extent that there may be intent or gross negligence on the part of Ticketsplus.
ARTICLE 7. FINAL PROVISIONS
7.1 Ticketsplus is entitled to unilaterally amend these conditions.
7.2 In cases where these conditions do not provide, Ticketsplus will decide.
